This Certification Companion Guide (CCG) is an informative document designed to assist with health IT product certification. The CCG is not a substitute for the requirements or other provisions specified in regulations. It extracts portions of ONC final rules’ preambles and includes subsequent clarifying interpretations specific to 45 CFR 170.401 or notes. The full text of information blocking regulatory provisions is codified in 45 CFR part 171, which is available online from the Code of Federal Regulations website (eCFR.gov). Attestation Requirements

Outlined below is a summary of the attestation requirements for the Information Blocking Condition of Certification (45 CFR 170.401). This attestation is a part of the Attestations Condition and Maintenance of Certification requirements available for developers to attest semiannually (beginning on April 1, 2022) alongside the other attestation requirements in 45 CFR § 170.406.   • A health IT developer must not take any action that constitutes information blocking on or after April 5, 2021.

Certification Requirements

Applicability of Condition: The Condition of Certification applies to all health IT developers participating in the ONC Health IT Certification Program (“Certified Health IT developers”). A Certified Health IT Developer is responsible for ensuring that all of its health IT and related actions and behaviors do not constitute information blocking or inhibit the appropriate access, exchange, and use of electronic health information (EHI).
